Under Arizona Revised Statute (ARS) §13-1406, sexual assault is committed when a person intentionally or knowingly engages in sexual intercourse or oral sexual contact with another person without their consent.

Arizona statutes carry much harsher sentencing for sexual assault conviction than many other states. And the sentencing becomes even harsher when the case involves aggravating circumstances.

For example, if the victim is under 15 years old and the accused is 18 or older, then the victim’s age is an aggravating factor. Sentencing for an adult convicted of sexual assault of a child under 15 is punishable under ARS §13-705, which calls for life in prison without possibility of parole or probation until after serving 35 years.
